California requires additional information regarding our privacy practices and your privacy rights. If you are a resident of California (“Consumer”), we provide you additional notices about our privacy practices and consumer rights relating to your personal information.
The Durst Organization and its affiliates and (collectively, “Durst,” “we,” “us,” or “our”) provides this California Privacy Notice at Collection and Privacy Rights (the “California Privacy Notice”) to Consumers to supplement the information contained in the Durst Privacy notice. In the event of a conflict between the California Privacy Notice and the Durst Privacy Notice, the disclosures in this California Privacy Notice shall apply.
We may change this California Privacy Notice from time to time. If we make changes, we will notify you by revising the date at the top of this notice. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this California Privacy Notice regularly to stay informed about our information practices and the choices available to you.
The California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act affords consumers certain rights with respect to their personal information. If you are a California resident, this section applies to you.

We may collect personal information from you in a variety of different situations, including, but not limited to our Site, when you fill out a form or application, through email, through the mail, over the telephone, and/or in any other situation where we interact with you. More specifically, Durst collects the following categories of personal information from its Consumers, which will depend on the particular Business Purpose for which we collect it:

We may collect the personal information that you provide about other individuals in certain cases. For example, we may collect information about your emergency contacts. By providing such information, you are representing that you have the required permissions and consents to disclose such information.
Personal information does not include deidentified information or aggregate consumer information.

We do not use sensitive personal information to infer characteristics about you.
We will not retain your personal information for longer than is reasonably necessary to carry out the purposes we disclose in this California Privacy Notice. For example, CCTV footage is retained for a period of 90 days and transactional logs from keycard readers are stored for one year.
The CCPA requires that we notify you if we “share” your personal information with third parties. For purposes of the CCPA, “sharing” means that we make available or otherwise disclose your information to third parties for cross-context behavioral advertising, such as targeting of advertising to you based on your personal information obtained from your activity across businesses, websites, apps, and services other than our Site.
The CCPA also provides for certain disclosures about personal information we “sell,” which means certain scenarios in which Durst has disclosed personal information with third parties or affiliates in exchange for valuable consideration, which could include situations where we “share” your personal information as described above for cross-context behavioral advertising. In the preceding twelve (12) months, Durst has “sold” or “shared” your personal information, including identifiers and internet or other network activity, to the extent “sharing” is considered a “sale” (as described above).
We do not engage in sales or sharing using personal information about consumers we know to be under the age of sixteen (16).

Subject to certain limitations and depending on your state of residence, you may have the right to: (1) request to know more about the categories and specific pieces of personal information we collect, use, disclose, and sell, and to access your information, including in a portable format, (2) request deletion of your personal information collected from or about you, which may include derived data, (3) request correction of your personal information, (4) opt out of any “sales” or “sharing” of your personal information that may be occurring; and (5) not be discriminated against for exercising these rights.

You can opt out of cross-context behavioral advertising “sales” or “sharing” by following the prompts behind the Your Privacy Choices link in the site footer. You can also opt out of certain sharing and sales by visiting our Services with a recognized universal choice signal enabled (such as the Global Privacy Control). Please note that, depending on which opt-out preference signal you use, our processing of the signal may be limited to the specific browser or device that you are using. You may need to renew your opt-out if you use a different browser or device to access our Services. You can opt-out of targeted advertising that is not based on cookies or tracking technologies by contacting us at the email or phone number above.
Only you, or a person authorized to act on your behalf, may make a verifiable consumer request related to your personal information. If we receive your request from an authorized agent and they do not provide a valid power of attorney, we may ask the authorized agent to provide proof that you gave the agent signed permission to submit the request to exercise rights on your behalf. In the absence of a valid power of attorney, we may also require you to verify your own identity directly with us or confirm to us that you otherwise provided the authorized agent permission to submit the request. You may appeal a decision relating to your consumer privacy rights request by contacting us at 833-693-6600 or at privacy@durst.com. If you would like to submit a verifiable consumer rights request, please do so via one of the two designated methods described above. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
We provide discounts, rewards, exclusive offers, or other benefits to customers who participate in a promotional campaign. These offerings may constitute “financial incentives” under the CCPA. If you decide to participate in a financial incentive, we collect personal information from you, such as identifiers (like your name, email address), commercial information (like purchase history), and inferences (collected through cookies, pixels, and other technologies, like products viewed).
Durst uses your Information to provide the financial incentives and to improve its business. We may disclose this Information to our service providers, contractors, and consultants who perform services on our behalf. Service providers may include, without limitation, entities such as analytics service providers, cloud-hosting services, account-related services (including updating of financial information and communications related to collections), database service providers, and backup and disaster recovery service providers. Additional entities may include our marketing and advertising partners, including for the purpose of engaging in targeted advertising and other marketing activities. We do not share or sell personal information to third parties for their marketing purposes.
You can opt into a financial incentive by following the sign-up or participation instructions provided, and you have the ability to opt-out at any time by following the instructions set forth in the applicable loyalty program or promotional campaign or contacting us at info@durst.com. If you request that we delete any of your personal information that is essential to providing you with the financial incentive, we will not be able to provide you with the benefits of that program (e.g., if you ask us to delete your email address, we will no longer be able to provide you with coupons).
In some cases, we may provide additional terms and conditions, which we will provide to you when you sign up. The value of your personal information is reasonably related to the value of the offer or discount presented to you.
